Rules & Regulations

On November 19, 2018, the Board of Directors amended the Rules & Regulations as follows:

1-13.1. Overnight Guests When a Unit Owner is in residence, there is no limitation on the number of overnight Guests who may stay in the Unit. When a Unit Owner is not in residence, the number of overnight Guests who may stay in the Unit is limited to two per bedroom. Guest occupancy in the absence of the Unit Owner by members of the Unit Owner's immediate family (spouse, parents, grandparents, children and grandchildren) shall not be limited.  Guest occupancy in the absence of the Unit Owner by all other persons shall be limited to 30 days cumulatively in a calendar year for all such Guest occupancy. Access will be denied to Guests in the absence of the Unit Owner upon the expiration of said 30 days of Guest occupancy period in a calendar year.  Any portion of a day will count as one day of guest occupancy.  Remaining days of Guest Occupancy at the end of the calendar year do not carry over to the next year.  Unit Owners having Guests to stay in their Unit(s) in violation of the 30-day rule may be prohibited from having any Guest occupancy in the next calendar year.

1-17.8. Recreation Areas Use of all recreational and common areas is restricted to Residents, Renters and Overnight Guests only, except when the Resident or Renter is present on the property. When the Resident or Renter is present on the property they may have non-overnight guests use the recreational and common areas. However, the use of the gym is restricted to Residents, Renters and Overnight Guests only. Residents and Renters may have fitness professionals provide instruction in the gym; however, the fitness professional must leave the gym when the Resident or Renter leaves the gym.  All gym equipment is to remain in the gym and is to be replaced in its designated storage area after use. All other rules also apply to non-overnight guests.

1-17.10. Recreation Areas If an owner or resident, while in residence, has more than 20 (twenty) guests on the property at one time and wishes to use a common area for their party or function, they must reserve either the Party Room, Living Room or Card Room for their event.  No other common area may be used for functions planned by unit owners with more than 20 guests.  A request for an exception to this rule can be made to the Property Manager at least 30 days prior to the proposed event. Approval for such an event will be at the sole discretion of the Board of Directors. (NEW RULE)

1-18.13. Rental Requirements Any returned check fees incurred due to a cancelled check, stopped payment, insufficient funds or any other bank related issue is the responsibility of the unit owner.  (NEW RULE)

1-23.7. Construction in Units and Moving In or Out Except in an emergency, no moving, construction, installation, maintenance or repair work is permitted before 8:30 a.m. or after 5:00 p.m., Monday through Friday, nor at any time on Saturdays, Sundays or the following federal holidays: New Year’s Day, Martin Luther King Day, Presidents’ Day, Memorial Day, Independence Day, Labor Day, Veterans Day, Thanksgiving Day, Christmas Day, Passover (1st two nights), Rosh Hashanah (2 days) and Yom Kippur as well as the days between Christmas Day and New Year’s Day.   No exception to these times is permitted unless expressly approved by the Property Manager.


On September 17, 2018, the Board of Directors amended the Rules & Regulations 1-17.8 as follows:

On September 21, 2015, the Board of Directors enacted the following resolution:
Be it resolved, effective October 1, 2015 the Board of Directors of the Barclay, Inc. Condominium Association will strictly enforce the existing rule that only unit owners may attend, participate, or speak at meetings of our Association whether meetings of the Board of Directors or Committees.  We further resolve that the Board of Directors has interpreted the term "owners" to  include the unit owner(s) of record and/or their lawfully wedded spouse.


At the Board of Directors meeting on August 17, 2015 there were 2 motions passed regarding pool and pool deck rules. The first one prohibits residents from confronting other residents in regards to pool or pool deck rules violations. The second now allows the use of swim diapers as recommended by Chapter 64-E-9.006(2) (f) 7 of the Florida Administrative Code. The full text of the motions can be found here.
